Terms of service.

In booking pet portrait session contract agreement indicates you have read, agreed with and understand the terms and conditions in this agreement. If you have any questions, please let us know before the session. This document is a contract agreement made between: One2 Cre8 Inc./One2 Pets (referred to hereafter as “Photographer/we/us/staff”) and the client (referred to hereafter as “you”). No other agreements have been made by either of the parties except as set forth herein.

Health and Safety

The client assumes all responsibility, including any destruction of personal, business or public property and injury. The client shall disclose any behavioral issues and illness before the session (such as aggression, allergies, anxiety, nervousness, etc). One2 Cre8 Inc. reserves the right to decline to book or terminate any session or services that pose a health and safety risk to you, the staff, other people or property in the building.

Copyrights and Creative Use

All images, original and processed, remain the sole property of One2 Cre8 Inc. It is illegal to copy or reproduce any photographs, either physically or digitally, without our permission. All images, both physical and digital when purchased or provided to the client are for personal use only. No commercial use by client is permitted under our terms, including but not limited to resale, promotion of personal business, or use in contests or exhibitions. The client must credit the photographer/company (@one2pets/@one2cre8ca) when sharing any images.

Pricing Disclosure & Payment Policy

The client has reviewed the price tables for the services and agrees to the pay the full written price after the session. Pricing can be subject to change. The client’s credit card information will be recorded when booking. Additional prints (not included within the package) may be ordered at any time thereafter. No photos will be released to client if full payment is not made.

Model Release

You hereby grant permission for One2 Cre8 Inc. to use and publish your images (with or without your or your pet’s name) in any and all forms of media, for the purpose of self-promotion, publicity, publishing (including electronic forms and internet websites), resale as prints or other media for commercial purposes.

Schedule and Time

Please arrive on time for your session. If you are late, your session length may be reduced accordingly or cancelled, with a penalty fee of $150. Photographer is not responsible if client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer.

Limit of Liability

We take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the session, Photographer will make every effort to reschedule to the earliest possible date. If the situation should occur, and the session must take place on the scheduled date the Photographer will make reasonable effort to secure an alternative photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.

Cancellation and Postponement (Jan to Sept)

Client understands that by entering into this agreement, Photographer is foregoing other photographic sessions. In the event of a cancellation or postponement of the session/agreement by client, 24 hours notice of postponements or cancellations is needed. If the client postpones or cancel the photo session less than 24 hours notice, or fail to show up (no-show) to the booked session, a penalty fee of $150 will be charged to client’s card on file.

Holiday Seaseon Cancellation and Postponement (Oct to Dec)

During the months from October to December, cancellation is not accepted after session is booked. If you need to postpone, you may reschedule at least 24 hours before your session starts. Fail of appearance (no-show) will be charged with the full session price.

Weather

If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
